JKPSC Rejects Candidature for Consultant Dermatology Post Under SLC Category: Here’s the Full Order

The Jammu and Kashmir Public Service Commission (JKPSC) has officially rejected the candidature and representation related to the post of Consultant Dermatology under the Socially and Educationally Backward Classes / SLC category in the Health & Family Welfare Department. The decision has been communicated through a detailed notice dated January 19, 2026, bringing an end to a prolonged legal and administrative process spanning several years.

The order clarifies the status of the post, outlines the litigation history, and explains why the Commission is no longer competent to make any recommendation against the said vacancy.

Background of the Consultant Dermatology Post

The post of Consultant Dermatology under the Health & Family Welfare Department was originally advertised vide Notification No. 12-PSC(DR-P) of 2019 dated 01.10.2019. The post was notified under the SLC (Socially and Educationally Backward Classes) category.

Following the completion of the selection process, the select list was issued vide Notification No. 73-PSC(DR-S) of 2021 dated 25.09.2021. Under this list, Dr. Mohd. Rafiq Tilwani secured 58.71 points and was provisionally selected for the post.

However, despite the issuance of the select list, the recommendation was not forwarded to the Administrative Department due to ongoing litigation.


Legal Challenge Before the High Court

The matter took a legal turn when Dr. Masrat Jabeen vs State of J&K and Others was filed before the Hon’ble High Court of Jammu & Kashmir at Jammu. The petitioner challenged the reservation category of the post, arguing that it should have been advertised under the ST (Scheduled Tribe) category instead of SLC.

On 02.11.2019, the Hon’ble High Court passed interim directions stating that while the selection process could continue, the finalization of the selection should remain stayed until further orders.

This interim order effectively stalled the appointment process despite the select list being prepared.

Transfer of Case to Central Administrative Tribunal (CAT)

Subsequently, the case was transferred to the Central Administrative Tribunal (CAT), Jammu Bench, where it was registered as TA No. 61/842/2020 (MA No. 1059/2022).

On 17.03.2025, the Hon’ble CAT Jammu issued directions vacating the interim stay and allowed the selection process to go ahead as per the original advertisement.

However, by the time this order was passed, significant administrative changes had already occurred regarding the status of the post.


Administrative Council Decision and Withdrawal of Posts

In the meantime, the Administrative Council of Jammu and Kashmir, in its decision dated 29.01.2022, resolved that:

  • All posts that remained unfilled as of 31.10.2019 and
  • Were under litigation or withdrawn,

would be returned to the respective Administrative Departments.

Following this decision, the post of Consultant Dermatology in question was returned to the Health & Family Welfare Department vide letter No. PSC/DR/Posts/2019 dated 11.02.2022.

Later, the General Administration Department (GAD) further clarified the position through Office Memorandum No. GAD-MTGORBIV/35/2022-09-GAD-Part(3) dated 03.08.2023, stating that:

  • All such returned posts would be treated as available with the Administrative Departments, and
  • Not with the respective recruiting agencies, including JKPSC.

JKPSC’s Final Deliberation and Decision

In light of the above developments, the matter was again examined by the JKPSC, especially after receiving directions from the Hon’ble Central Administrative Tribunal, Srinagar, dated 17.03.2025.

After deliberation, the Commission observed that:

  • The post had already been withdrawn by the General Administration Department pursuant to the Administrative Council’s decision.
  • The post was returned to the Administrative Department and was no longer available with JKPSC.
  • As such, the Commission could not make any recommendation against a post that was no longer under its purview.

Rejection of Representation Filed in March 2025

Based on these findings, the JKPSC formally rejected the claim/representation dated 19.03.2025 submitted by Dr. Mohd. Rafiq Tilwani, resident of Awantipora, Chadoora.

The Commission held that the representation was devoid of merit, as the post itself no longer existed with the Commission for recruitment or recommendation.
