Background of the Consultant Dermatology Post

The post of Consultant Dermatology under the Health & Family Welfare Department was originally advertised vide Notification No. 12-PSC(DR-P) of 2019 dated 01.10.2019. The post was notified under the SLC (Socially and Educationally Backward Classes) category.

Following the completion of the selection process, the select list was issued vide Notification No. 73-PSC(DR-S) of 2021 dated 25.09.2021. Under this list, Dr. Mohd. Rafiq Tilwani secured 58.71 points and was provisionally selected for the post.

However, despite the issuance of the select list, the recommendation was not forwarded to the Administrative Department due to ongoing litigation.

Legal Challenge Before the High Court

The matter took a legal turn when Dr. Masrat Jabeen vs State of J&K and Others was filed before the Hon’ble High Court of Jammu & Kashmir at Jammu. The petitioner challenged the reservation category of the post, arguing that it should have been advertised under the ST (Scheduled Tribe) category instead of SLC.

On 02.11.2019, the Hon’ble High Court passed interim directions stating that while the selection process could continue, the finalization of the selection should remain stayed until further orders.

This interim order effectively stalled the appointment process despite the select list being prepared.

Transfer of Case to Central Administrative Tribunal (CAT)

Subsequently, the case was transferred to the Central Administrative Tribunal (CAT), Jammu Bench, where it was registered as TA No. 61/842/2020 (MA No. 1059/2022).

On 17.03.2025, the Hon’ble CAT Jammu issued directions vacating the interim stay and allowed the selection process to go ahead as per the original advertisement.

However, by the time this order was passed, significant administrative changes had already occurred regarding the status of the post.

Administrative Council Decision and Withdrawal of Posts

In the meantime, the Administrative Council of Jammu and Kashmir, in its decision dated 29.01.2022, resolved that:

  • All posts that remained unfilled as of 31.10.2019 and
  • Were under litigation or withdrawn,

would be returned to the respective Administrative Departments.

Following this decision, the post of Consultant Dermatology in question was returned to the Health & Family Welfare Department vide letter No. PSC/DR/Posts/2019 dated 11.02.2022.

Later, the General Administration Department (GAD) further clarified the position through Office Memorandum No. GAD-MTGORBIV/35/2022-09-GAD-Part(3) dated 03.08.2023, stating that:

  • All such returned posts would be treated as available with the Administrative Departments, and
  • Not with the respective recruiting agencies, including JKPSC.

JKPSC’s Final Deliberation and Decision

In light of the above developments, the matter was again examined by the JKPSC, especially after receiving directions from the Hon’ble Central Administrative Tribunal, Srinagar, dated 17.03.2025.

After deliberation, the Commission observed that:

  • The post had already been withdrawn by the General Administration Department pursuant to the Administrative Council’s decision.
  • The post was returned to the Administrative Department and was no longer available with JKPSC.
  • As such, the Commission could not make any recommendation against a post that was no longer under its purview.

Rejection of Representation Filed in March 2025

Based on these findings, the JKPSC formally rejected the claim/representation dated 19.03.2025 submitted by Dr. Mohd. Rafiq Tilwani, resident of Awantipora, Chadoora.

The Commission held that the representation was devoid of merit, as the post itself no longer existed with the Commission for recruitment or recommendation.

Official Order and Signatory

The rejection order has been issued under:

  • No: PSC/DR/Conslt/H&FW/2019
  • Dated: 19-01-2026

The notice has been signed by Mushtaq Ahmad, JKAS,
Additional Secretary, Jammu and Kashmir Public Service Commission.

What This Means for Aspirants

This case highlights several important points for government job aspirants in Jammu and Kashmir:

  1. Litigation can significantly delay or nullify selections, even after select lists are issued.
  2. Administrative Council decisions can override recruitment timelines if posts remain unfilled for extended periods.
  3. Recruitment agencies like JKPSC can only recommend candidates for posts officially available with them.
  4. Candidates should closely monitor legal and administrative developments related to advertised posts.

The rejection of the candidature for the Consultant Dermatology post under the SLC category marks the conclusion of a long-standing recruitment dispute involving legal challenges, tribunal proceedings, and administrative restructuring. While the select list was issued as early as 2021, subsequent developments rendered the post unavailable for recommendation by JKPSC.

For aspirants, this case serves as a reminder of the complexities involved in public service recruitment and the critical role of administrative and judicial decisions in shaping final outcomes.

500 Out of 500: JKBOSE’s New Evaluation Method Triggers Education Debate

0

This year, the board surprised stakeholders as over a dozen students were awarded 100 percent marks—500 out of 500—in the class 10th and 12th examinations

Srinagar: A new evaluation system by the J&K Board of School Education (JKBOSE) has ruffled feathers, with the awarding of perfect scores to students in annual examinations triggering questions about assessment standards.

This year, the board surprised stakeholders as over a dozen students were awarded 100 percent marks—500 out of 500—in the class 10th and 12th examinations.

The JKBOSE declared results this week with overall pass rates of 84.02 percent for class 10th and 85.03 percent for class 12th. However, the perfect scores awarded to some students have ignited a debate over the board’s evaluation methods.

Traditionally, students from primary to high school level would not receive 100 percent marks in language subjects, even when answering all questions correctly. One mark was routinely deducted by default.

The new trend has left educationists confused, seeking answers to what they call the curious case of “perfection.”

“Securing a perfect score of 500 out of 500 in the Class 10 examination raises important questions about the effectiveness of the current evaluation system. When students achieve full marks, it suggests that the assessment may no longer be adequately differentiating levels of understanding or encouraging higher-order thinking,” Tariq Wani, a parent, wrote on social media.

“This situation prompts a critical review of whether such examination patterns truly measure academic depth, creativity, and problem-solving skills,” he said.

Wani called for reconsidering and reforming the examination framework to ensure it better supports meaningful learning and fairly evaluates student potential.

Educationists warn that awarding 100 percent marks in board exams risks creating unrealistic expectations and breeding overconfidence among teenage students.

“It is high time to change the evaluation system and syllabus of JKBOSE. Giving 100 percent marks may give overconfidence to students but can prove disastrous at any point,” said Shazia, a parent.

The concern is that labelling teenagers as “perfectionists” based on exam scores could set them up for disappointment in more rigorous academic or professional environments.

While stakeholders debate the wisdom of awarding perfect scores—particularly in language subjects where subjectivity typically plays a role—JKBOSE officials have defended the move as aligned with new educational reforms.

“Since the implementation of NEP-2020, the focus has shifted to conceptual learning. So be it any subject, including languages, if the evaluator feels the student has a clear concept and has written to the point, he does not deduct any marks. This is the reason why students are awarded 500 out of 500 marks,” a JKBOSE official told Greater Kashmir.

The explanation marks a fundamental departure from traditional evaluation methods that emphasised technical perfection to a new approach prioritising conceptual clarity.

However, critics argue that even under a conceptual learning framework, the complete absence of score differentiation may fail to capture the nuances of student understanding—raising questions about whether the board has conflated encouragement with rigorous assessment, and whether perfect scores truly serve students’ long-term educational interests.
