J&K High Court directs DC Kupwara to hold fresh enquiry into engagement of ReTs

Kupwara, Jul 27 (KNO): The J&K and Ladakh High Court has directed Deputy Commissioner Kupwara to conduct an inquiry into engagement of ReTs for which applications were invited in 2010 and submit a report within eight weeks.
The petitioner submitted in the court that she had applied for the posts of RET for which applications were invited by the ZEO Kupwara for Primary School Wani Mohallah Manzhar in 2010.
After hearing the counsel for parties, the court as per news agency—Kashmir News Observer (KNO) directed the Deputy Commissioner Kupwara to hold an enquiry into the matter and submit report to the court within eight weeks.
In view of the contradictory reports which are on the record of this petition and the fact that the earlier enquiry was conducted by the Principal, GHSS, Kupwara, the respondents cannot be heard saying that Principal, GHSS, Kupwara, had on his own conducted the enquiry, the court said.
The petition was heard by Justice Sindhu Sharma.
“With a view to test the veracity of the fact, it would be proper to get the enquiry with regard to these facts and circumstances conducted by any independent authority.
Accordingly, Deputy Commissioner Kupwara is directed to hold an enquiry with regard to the fact as to whether the petitioner had applied pursuant to Advertisement Notice dated 21.04.2010, and also with regard to the residence of the petitioner,” the court said.
The court said “Deputy Commissioner shall conduct the enquiry after issuing notice to all the parties and provide them an opportunity of hearing. The report in this regard shall be produced before this Court within a period of eight weeks.”
The case has been listed for hearing on September 22.
The petitioner contends that though she was eligible and meritorious and had applied for the above post, yet the respondents did not consider her for engagement, purportedly on the ground that she had not applied for the said post.
The chief education officer directed Principal, Girls Higher Secondary School Kupwara to conduct an enquiry in the matter and the Principal, GHSS, Kupwara stated that Incharge ReT engagement Ghulam Nabi Rather has produced original application file of the petitioner along with photocopy of master list containing 16 candidates which includes the name of the petitioner.
The petitioner submitted that no action was taken despite the report against the selected candidate, prompting the petitioner to approach the Court for seeking quashing of selection list. The plea said that the petitioner is more meritorious and entitled to be selected and selection of selected candidate Syed Talib Hussain is a product of fraud.
“They have denied the assertions as well as handing over files for verification and preparation of panel as baseless.
“In-charge, Abdul Hamid Dar, has also signed the letter provided to the petitioner under the RTI Act that she had not applied for the said post,” the petitioner told the court.
It has also been submitted that they have also denied the list of 16 candidates as completely baseless and the enquiry officer, according to them, has not gone through the report of District Education Planning Officer, Kupwara, as well as of Chief Education Officer.
