Government Schools Can Now Fail Class 5 and 8 Students as ‘No-Detention Policy’ Ends

The central government has scrapped the ‘no-detention policy’ for Class 5 and Class 8 students, allowing those who fail exams to repeat the year after a second chance to pass.

The central government has made a major change in education policy, ending the “no-detention policy” for fifth and eighth graders. This means that students in these classes who fail their year-end exams can now be held back and must repeat the grade.

“The Union Education Ministry has taken a big decision and abolished the ‘No Detention Policy’. Students who fail the annual examination in classes 5 and 8 will be failed,” Sanjay Kumar, Secretary, Department of School Education & Literacy, posted on X today.

“Failed students will have a chance to retake the test within two months, but if they fail again, they will not be promoted. The school will not expel a student until the 8th grade. Central Government has taken this decision intending to improve the learning outcome among children,” he wrote.

WHAT DOES THIS CHANGE MEAN?

 

 

This new rule applies to over 3,000 central government-run schools, including Kendriya Vidyalayas, Navodaya Vidyalayas, and Sainik Schools, as per senior education ministry officials. The decision, announced through an official notification, reverses the 2019 amendment to the Right to Education Act.

Under the new rule, students who fail their exams will get a second chance to pass within two months. If they don’t meet the promotion requirements after the re-examination, they will be held back in the same grade.

“If the child appearing in the re-examination fails to fulfil the promotion criteria again, he shall be held back in fifth class or eighth class, as the case may be,” the notification stated.

 

In July 2018, the Lok Sabha passed a bill to amend the Right to Education (RTE) Act, which aimed to end the ‘no detention policy’ in schools. The amendment introduced regular exams for Classes 5 and 8, with a provision for students who fail to have a re-examination opportunity within two months.

In 2019, the Rajya Sabha approved the Right of Children to Free and Compulsory Education (Amendment) Bill, which sought to remove the ‘no detention policy’ for up to Class 8 to improve learning outcomes. The bill granted state governments the discretion to either continue or abolish the policy, allowing them to hold students back in Classes 5 and 8 if they fail their year-end exams.

SUPPORT FOR STRUGGLING STUDENTS

 

The government also mentioned that teachers will provide additional guidance to address any learning gaps for students who are held back. However, the government has reassured that no student will be expelled before completing elementary education.

“During the holding back of the child, the class teacher shall guide the child as well as the parents of the child, if necessary, and provide specialised inputs after identifying the learning gaps at various stages of assessment,” the notification said.

Although education is mainly a state matter, the central government’s decision comes after 16 states and two union territories already discontinued the “no-detention policy” for these classes after the RTE Amendment Bill of 2019. While some states and union territories have yet to make a decision, others have opted to continue with the policy.

“Since school education is a state subject, states can make their decision in this regard. Already 16 states and 2 UTs including Delhi have done away with the no-detention policy for these two classes. Haryana and Puducherry have not made any decision yet while remaining states and UTs have decided to continue with the policy,” a senior official said.

The government clarified that each state can choose its own approach to this matter.

Srinagar, Dec 24 (KNO): The Member of Legislative Assembly (MLA) Dooru and senior Congress leader, Ghulam Ahmad Mir on Tuesday said that the Member of Parliament (MP) from Srinagar Lok Sabha constituency, Aga Ruhullah Mehdi, could have met the Chief Minister Omar Abdullah directly instead of resorting to “camera show”.

Addressing a news conference at party headquarters here in Srinagar, Mir as per the news agency—Kashmir News Observer (KNO), said that the MP Ruhullah was just a five minutes away from CM Omar Abdullah and instead of opting for “camera show”, the demands could have been raised with the Chief Minister directly.

“It has become a fashion now to get the camera attraction, otherwise the responsible MP from NC, could have behaved seriously,” he said while responding to a query on Ruhullah’s protest on Reservation policy outside CM’s residence—(KNO)

“Pure drama”: National Conference slams party MP Aga Ruhullah for leading student protest

Says MP’s presence gave “our adversaries” an opportunity to exploit the situation

Srinagar, Dec 24: National Conference leader and MLA Hazratbal, Salman Ali Sagar Tuesday expressed strong dismay over the protest led by party’s own Member of Parliament from Srinagar, Aga Ruhullah over reservation policy row. The protest was also joined by several opposition leaders and legislators.

Speaking with reporters at NC headquarters in Srinagar, Salman Sagar, as per news agency—Kashmir News Observer (KNO) said that if the MP believes that he can do it, then that’s his individual prerogative, however, this was not the National Conference’s initiative.

Salman said that the party only organises protests after instructions from senior leaders such as Dr Farooq Abdullah, Omar Abdullah, or after directives from the general secretary’s office. “Such protests are not organised independently by individuals. They must be authorised by the party leadership. What happened yesterday was entirely an individual action and not a National Conference event,” he said.

“A Gathering of Rivals”

Salman said the protest was a platform for the party’s adversaries. “It was a gathering of our adversaries, of our enemies. Unfortunately, one of our MPs was present there, giving them an opportunity to exploit the situation,” Salman said, adding that such actions inadvertently strengthen the position of political rivals like the Peoples Democratic Party (PDP).

Salman accused the protest organisers of failing to consider better ways to address grievances. “If grievances truly needed redressal, there were better ways to address them. What happened yesterday, in my personal opinion, was pure drama. It didn’t benefit anyone,” he said.

While reiterating his support to students’ concerns, Salman said that the National Conference stands with the students of the open merit category. “I openly declare in front of you that I stand with the students of the open merit category. Their grievances must be addressed based on their population percentage. However, we will not allow politics to be played on this issue,” he said.

He also took a dig at political opportunism, stating that the protest gave a platform to individuals who have no real stake in the issue. “People with no mandate, those who have been rejected by the public with barely 200 votes, were speaking on behalf of thousands or even millions. This kind of behavior undermines genuine efforts,” Salman said.

Salman expressed concern about the damage such actions could inflict on the party’s credibility and unity. “The National Conference is a very large party, and small incidents or dirty politics won’t affect us. But actions like these create unnecessary internal strife. We have faith that under Omar Abdullah’s leadership, the aspirations of the open merit category will be addressed through the reservation policy,” he said.

Salman also questioned the role of those who organised and participated in the protest. “If genuine stakeholders had been engaged, it would have been meaningful. But this was clearly about internal issues and political point-scoring,” he said.
