UGC New Rule Row: Supreme Court Stays 2026 Equity Regulations, Orders Colleges To Follow 2012 Norms

0

The Supreme Court has stayed the University Grants Commission’s (UGC) newly notified Promotion of Equity in Higher Education Institutions Regulations, 2026, directing all higher education institutions to continue following the UGC Regulations, 2012 until further orders.

The interim decision comes amid nationwide controversy, protests, and political reactions over the 2026 framework, which mandates equity committees and related mechanisms in universities and colleges.

Supreme Court’s Interim Order: What Happened?

According to the updates, the Supreme Court on January 29, 2026 passed an interim order staying the new UGC regulations. The Bench directed that all institutions must continue applying UGC Regulations, 2012 for the time being.

The Court also issued notice to the Centre and the UGC, and the matter is listed for further hearing on March 19.

Why Were The 2026 Regulations Introduced?

UGC notified the 2026 equity regulations on January 13, aiming to strengthen campus mechanisms to address discrimination and promote inclusion. The rules made it mandatory for institutions to set up equity committees with representation including members from OBC, Scheduled Caste (SC) and Scheduled Tribe (ST) communities.

The idea, as explained in earlier reports, was to curb caste-based discrimination in higher education and ensure equal opportunity within institutions.

What Triggered The Controversy?

Soon after the new regulations were notified, they sparked sharp criticism and protests, especially among sections of general category students, who claimed the rules were biased and could be misused. The issue became politically sensitive with resignations and widespread backlash being reported.

What Did The Supreme Court Observe?

During the hearing, the Supreme Court reportedly expressed concerns that the regulations appeared vague and could potentially be misused due to unclear language.

The Court also flagged that the rules could have serious consequences and even deepen social division if implemented without safeguards.

Article 142 Invoked

Importantly, the Supreme Court passed the interim stay by invoking its powers under Article 142 of the Constitution, which allows it to pass orders necessary to do “complete justice” in a matter.

What Rules Will Institutions Follow Now?

With the stay in place:

✅ The UGC Regulations, 2012 remain applicable
✅ The 2026 equity regulations will not be implemented for now
✅ Institutions must follow existing frameworks until the Supreme Court gives further directions

Political Reactions Continue

The issue has also triggered political statements from multiple leaders. NDTV reported reactions including comments from BJP MP Nishikant Dubey, and clarification from Congress leader Digvijaya Singh about the parliamentary standing committee’s role.

What Happens Next?

The Supreme Court will hear the matter again on March 19, and a final decision may decide whether the 2026 framework is modified, withdrawn, or implemented with safeguards.

Until then, universities and colleges across India must operate under the earlier UGC rules.

  • Answer script is evaluated again
  • Potential corrections in marking
  • Total marks can increase, decrease, or remain unchanged

  • Useful if you want to decide whether to go for re-evaluation

To avoid mistakes, students from both divisions should remember:

  • Apply as early as possible (don’t wait till the last date)
  • Carefully select the subject(s)

  • Keep checking JKBOSE website for photostat schedule updates
  • Do not rely on rumours—follow official updates only

How Long Does the Process Take?

JKBOSE usually processes re-evaluation and photostat applications in phases, depending on:

  • Number of applicants
  • Subject-wise workload
  • Availability of secrecy section schedules

Students are advised to remain patient and keep checking updates on the JKBOSE website.

Impact on Result/Marks Certificate

After re-evaluation:

  • If marks change, the revised marks may be updated officially

IUST Recruitment 2026 Update: Addendum-cum-Corrigendum-II Released for Advertisement Notice No. 01 of 2026

0

The Islamic University of Science & Technology (IUST), Kashmir has issued an important official update regarding its ongoing recruitment process. The university has released an “Addendum-cum-Corrigendum-II” to the Advertisement Notice No. 01 of 2026 dated 01.01.2026, introducing key clarifications and modifications related to eligibility conditions and category-based vacancy rules.

This update is crucial for all aspirants applying for teaching positions at IUST, especially those applying under the EWS category and those seeking posts such as Assistant Professor, Associate Professor, and specialized positions like Assistant Professor (Planning).

Candidates are strongly advised to go through the corrigendum carefully to understand the revised provisions so that they do not miss any eligibility benefit or apply under incorrect criteria.

Overview of the Addendum-cum-Corrigendum-II (IUST Recruitment 2026)

The corrigendum is essentially a continuation and partial modification of the earlier advertisement notice. It contains seven major points, each clarifying a recruitment rule or revising qualification requirements for specific posts.

The update primarily focuses on:

  • Rules related to EWS category posts
  • Expansion of eligible qualifications for certain posts
  • Corrections in essential qualifications for Vocational Studies posts
  • Revised essential eligibility for Assistant Professor (Planning) post

Major Highlights of IUST Corrigendum-II 2026

1. Clarification on EWS Category Posts and UR Candidates Eligibility

One of the most important points addressed in this corrigendum concerns recruitment under the Economically Weaker Section (EWS) category.

As per the update:

  • Posts earmarked under the EWS category are meant exclusively for EWS candidates.
  • However, since EWS vacancies are not carried forward as backlog vacancies, the university has clarified what happens if eligible EWS candidates are not available.

Key rule introduced: If there is non-availability or non-suitability of eligible EWS candidates, the post(s) may be filled under the Unreserved (UR) category.

Additionally, UR candidates are permitted to apply for EWS-designated posts, but:

  • They will apply at their own risk and responsibility
  • Their candidature will be considered only if no suitable EWS candidate is available

📌 Why this matters:
This clarification is highly beneficial for UR candidates, as it opens an additional opportunity — though selection will remain conditional.

2. Master’s Degree in IT / CIT Eligible for Assistant Professor (Centre for Artificial Intelligence)

This corrigendum expands eligibility for the post of:

Assistant Professor, Centre for Artificial Intelligence

It clarifies that candidates with:

  • Master’s degree in Information Technology (IT)
    OR
  • Communication & Information Technology (CIT)

are also eligible for this post, provided they meet other requirements mentioned in the advertisement.

3. Master’s Degree in English / Buddhism / Sanskrit / Hindi Eligible for Assistant Professor (International Centre of Spiritual Studies)

Another major expansion in eligibility is for the post of:

Assistant Professor, International Centre of Spiritual Studies

Now candidates with Master’s degree in:

  • English
  • Buddhism
  • Sanskrit
  • Hindi

are declared eligible, subject to fulfilment of other requirements.

📌 Why it is important:
Earlier, applicants from language and humanities backgrounds might have been unsure of eligibility. This update clearly allows them to apply.

4. Correction in Essential Qualification for Associate Professor (Vocational Studies)

IUST has made a technical correction in the clause related to Associate Professor (Vocational Studies).

The corrigendum instructs to read the essential qualification as:

  • A Master’s degree with at least 55% marks
    (50% for SC/ST/OBC (non-creamy layer))
    OR equivalent grading system
in one of the following disciplines:
  • Medical Lab Technology
  • Immunology
  • Microbiology
  • Biochemistry
  • Clinical Biochemistry
  • Biotechnology
  • Haematology
  • Pathology
  • Pharmacology

This revised reading replaces the earlier text that had a slightly different structure/wording.

The qualification remains essentially the same but has been corrected for accuracy and clarity, which helps avoid confusion during scrutiny.

5. Updated Eligibility for Assistant Professor (Vocational Studies)

Another important correction is related to eligibility for:

Assistant Professor (Vocational Studies)

The corrigendum states that the essential qualification should be read as:

  • M.Sc. in Medical Lab Technology / Biochemistry / Clinical Biochemistry / Biotechnology with
  • Ph.D. in Immunology / Microbiology / Biochemistry / Clinical Biochemistry / Haematology / Pathology / Pharmacology

This updated clause replaces the earlier version in the advertisement.

📌 Why this update is significant:
This specifies the exact Master’s degree disciplines as well as the acceptable Ph.D. specialization areas, reducing ambiguity in eligibility evaluation.

6. Minimum Marks Requirement for Assistant Professor (Vocational Studies)

IUST also clarified the minimum marks requirement for Master’s degree for the post of:

Assistant Professor (Vocational Studies)

Requirement:

  • Minimum 55% marks in Master’s degree
    (or 50% for SC/ST/OBC non-creamy layer)
or equivalent grade under point-scale system

📌 This is a crucial checklist point for applicants planning to apply with borderline marks or grading conversions.

7. Revised Essential Qualifications for Assistant Professor (Planning)

One of the biggest revisions in the corrigendum is for the post of:

Assistant Professor (Planning)

The corrigendum replaces previously prescribed qualifications and now defines the essential qualifications as:

(i) Bachelor’s Degree:

  • Bachelor’s Degree in Architecture / Planning

(ii) Master’s Degree:

  • Master’s Degree in one of the following:
    • Planning
    • Regional Planning
    • Transportation Planning
    • Environmental Planning
    • Landscape Planning
    • Urban Planning
    • Town Planning
    • City Planning
    • Conservation Planning
    • Transport Planning

✅ Must have First Class or equivalent either in:

  • Master’s degree OR Bachelor’s degree

(iii) Experience:

  • Two (02) years of relevant professional experience

📌 Major takeaway:
Applicants for Assistant Professor (Planning) must ensure they fulfil both academic qualifications + professional experience, which is now clearly mandated.

Important Note for All Applicants

At the end of the corrigendum, IUST clearly states:

All other terms and conditions of Advertisement Notice shall remain same.

This means:

  • Application process remains unchanged
  • Selection method remains unchanged
  • Other eligibility clauses remain valid
  • Only the updated points in corrigendum will override the earlier notice

What Applicants Should Do Next?

To avoid rejection or scrutiny issues, candidates should take the following steps immediately:

✅ 1. Re-check Your Eligibility

If you belong to:

  • UR category applying for EWS posts
  • IT/CIT background applying for AI posts
  • English/Buddhism/Sanskrit/Hindi background applying for Spiritual Studies posts
  • Vocational Studies applicants
  • Planning discipline applicants

…you must re-check your eligibility according to the updated corrigendum.

✅ 2. Prepare Proper Documents

Make sure your documents match revised qualifications:

  • Master’s degree subject/discipline proof
  • Ph.D. specialization certificates (where required)
  • Marks sheets showing percentage/grade
  • Category certificate (EWS/SC/ST/OBC)
  • Experience certificates (Planning post)

✅ 3. Apply Carefully Under Correct Post Code

Many candidates commit mistakes in:

  • Selecting wrong post
  • Selecting wrong category
  • Uploading incorrect documents

Since the corrigendum changes eligibility/terms, be careful during online application.

Why Corrigendum-II is a Big Opportunity for Candidates

This update is particularly beneficial because:

✅ More candidates are now eligible for key posts
✅ UR candidates get additional chance for EWS-designated posts (conditional)
✅ Planning post requirements are clearly defined, preventing confusion
✅ Vocational Studies qualifications corrected to ensure fair evaluation
