NEET SS 2023 not to be held in Srinagar due to security reasons: NBEMS

NEW DELHI : Srinagar has not been considered as an exam city for the National Eligibility Entrance Test for Super Specialty (NEET SS) 2023 due to security reasons, the National Board of Examinations in Medical Sciences (NBEMS) said. NEET SS 2023 is scheduled for September 9 and 10.

In a letter to the Federation of All India Medical Association (FAIMA), the medical board said that the entrance exam will be conducted in Jammu where the candidates of Jammu and Kashmir can appear. FAIMA had requested an additional exam centre in Srinagar for NEET SS exam.

NBEMS executive director said that he got the issue examined with the concerned department and informed that the “high stake” exam will be held in 36 exam cities across the country. He explained that fixing of an exam city depends on multiple factors including the availability of secure test centres.

“The audit of available test centres in the city of Srinagar has revealed that the required standards of security are not met at the centres available to hold the examination as on date. Accordingly, Srinagar has not been considered as a test city for conduct of the said examination,” NBEMS stated.

Informing that NEET SS 2023 will be held in the city of Jammu for J-K candidates, the board said that it is not feasible to conduct the exam compromising any standards of security.

“No test centre was offered in the city of Srinagar in the last NEET-SS as well, held on 1st and 2nd September.

SI recruitment scam: SC issues notice to CBI in bail application

JAMMU, Aug 28: In the much publicized SI recruitment scam, a Bench of Supreme Court comprising Justice JB Pardiwala and Justice Manoj Misra has issued notice to the Central Bureau of Investigation (CBI) in bail application filed by Yatin Yadav.

After hearing both the sides, the Apex Court observed, “the petitioner came to be arrested in connection with the First Information Report bearing Crime No.RC0042022A 0008-CBI/ACB/ Jammu for the offence punishable under Section 120-B read with Sections 420, 411, 408 and 201, IPC”.

“Although there is some discrepancy as regards the exact date of the arrest of the petitioner, yet the senior counsel appearing for the petitioner, upon instructions, submitted that the petitioner was arrested on 17th September, 2022 and was remanded to police custody for a period of two days. Thereafter, on 19th September, 2022, the petitioner was sent to judicial custody”, the Apex Court said.

The investigating agency filed charge sheet on 12th November, 2022 i.e. well within the statutory time period of 60 days, as provided under Section 167 of the Code of Criminal Procedure, 1973. However, the petitioner preferred an application before the trial court seeking default bail as according to the petitioner although the charge sheet was filed well within 60 days, yet the same being an incomplete charge sheet, could not have been accepted by the trial court and no cognizance could have been taken on such incomplete charge sheet.

The argument before the Court of Magistrate was that since on the 61st day of his judicial custody, there was no valid and legal charge sheet on record, he was entitled to be released on default bail. Such argument did not find favour with the court and the bail application accordingly came to be rejected.

The petitioner went before the High Court, which also declined to entertain the bail application taking the view that what is contemplated under the scheme of Sub-Section (2) of Section 167 CrPC is completion of investigation relating to offence against the accused and not investigation of case or filing of charge sheet under Section 173 CrPC which would be material for the purpose for determining whether the accused is entitled to the grant of statutory bail or not.

The principal contention canvassed by Devadatt Kamat, the Senior Counsel appearing for the accused is that a plain reading of Section 173 of the CrPC shows that every investigation must be completed without unnecessary delay and as soon as it is completed, the officer-in-charge of the Police Station shall forward a report to the Magistrate in the form prescribed. Therefore, there is no question of sending up of a “police report” within the meaning of Section 173, Sub-Section (2) of CrPC until the investigation is completed.

Any report sent before the investigation is completed will not be a police report within the meaning of Sub-Section (2) of Section 173 of the CrP. read with Section 2(r) of the CrPC and there is no question of the Magistrate taking cognizance of the offence within the meaning of Section 190(1)(b) of the CrPC on the basis of an incomplete charge-sheet.

Apex Court observed, “whether the understanding of the High Court as reflected in para 27 of the impugned order is a correct statement of law, needs to be determined by this court as such notice is issued to CBI

SIA arrests Sarjan Barkati, Azadi Chacha of Kashmir

Srinagar, Aug 29, KDC: SIA Kashmir has arrested Sarjan Ahmad Wagay alias Barkati, in Case FIR No 02/2023 of police station SIA. The case pertains to Barkati’s involvement in orchestrating an extensive fund-raising campaign through crowd funding, resulting in the generation of funds amounting to crores. These funds were subsequently misused, involving money laundering and acquisition of undisclosed assets for propagation of radicalism within the Kashmir valley.

A top official told news agency Kashmir Dot Com that ‘Barkati, also known as “Azadi Chacha,” gained prominence in 2016 following the neutralization of Hizbul Mujahideen commander Burhan Wani by security forces. Sarjan Barkati was a central figure in orchestrating large-scale protests, rallies, and clashes with security forces in 2016, for which more than 30 FIRs were registered against him in various police stations of the valley.”

SIA Kashmir revealed that Barkati managed to raise approximately Rs 1.74 crores through crowd funding campaigns. These funds were ostensibly raised for personal gains and a significant portion of the collected funds was allegedly misused for undisclosed purposes, including possible financing of secessionist and terrorist activities.

He said during investigation SIA Kashmir has found that Barkati had not only exploited public sentiment and trust for personal financial gain but also potentially laundered funds from unidentified sources, suspected to have links with terrorist organizations.
Furthermore, a substantial portion of the acquired funds had been deposited in various Fixed Deposit Receipts (FDRs) under the names of Barkati’s family members, raising questions about the legitimacy of the sources and utilization of the funds, the officer said.

“The SIA Kashmir emphasized that Sarjan Barkati’s actions amounted to a betrayal of the public’s trust, as he allegedly manipulated emotional appeals and crowd funding platforms to further personal and potentially illicit agendas. The agency noted that Barkati’s activities not only tarnished the sanctity of crowd funding but also raised serious concerns about the misuse of such resources for promoting separatist-terrorist activities,” the officer added.
